HUD will accept an objection(s) to its approval of the release of funds and acceptance of the certification only if it is on one or more of the following bases: (a) the certification was not, in fact, executed by the State of Ohio's chief executive officer or other officer of the State; (b) the responsible entity has failed to make on one of the two findings pursuant to Section 58.40 or to make the written determination required by section 58.35, 58.47, or 58.53 for the project, as applicable; (c) the responsible entity has omitted one or more of the steps set forth at subpart of 24 CFR Part 58 for the preparation, publication and completion of an Environmental Assessment; (d); the responsible entity has omitted one or more of the steps set forth at subpart and of 24 CFR Part 58 for the conduct, preparation, publication and completion of an Environmental Impact Statement; (e) the recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before release of funds and approval of the environmental certification by the State of Ohio; or (f) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory for the standpoint of environmental quality.
